UM Upper Chesapeake Medical Center in the News

In December 2011, a claim was filed against UM Upper Chesapeake Medical Center (UM UCMC) by the husband and children of a patient who received an overdose of narcotics and subsequently died. According to the lawsuit filed by her family, Beverly Gargiulo was admitted to UM UCMC in February 2010 for treatment related to infected ulcers. Although there was no evidence to indicate her condition was life threatening, Gargiulo was allegedly told by hospital staff that she required hospice care. She was then administered increasing doses of opiates, including morphine and oxycodone, until they reached levels reserved for critically ill patients approaching death. The suit also contends that Gargiulo was subjected to painful and unnecessary procedures during her stay at UM UCMC.

Gargiulo died in March 2010 after what her family’s attorney alleged was an excruciating ordeal caused directly by UM UCMC doctors. Not only did they misdiagnose her necessity for hospice level care, he argued, they also triggered her premature death by administering toxic doses of narcotics that were inappropriate for someone with her condition. A Harford County Circuit Court jury agreed and awarded the family $958,258.
